3. Client Responsibilities
- It is the responsibility of the client ("you", "your") to ensure the security and integrity of your website(s) and email accounts.
- You agree not to use our Services for any illegal, fraudulent, or unauthorized purposes.
- You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account.
- Account Compromise and Security Breaches: You acknowledge that you are responsible for ensuring that your website(s) and any associated software, such as plugins, are secure and up-to-date. Any breach of service, including but not limited to compromised accounts, plugin vulnerabilities, or other exploits that negatively impact our servers or other users, may result in service suspension or additional charges. This includes actions such as sending spam, spreading malware, or allowing vulnerabilities that could be exploited for malicious purposes.
In the event your account is compromised or responsible for a breach of security, we reserve the right to charge additional fees to cover the costs of mitigation, investigation, and rectification of the issues caused.
4. IP Address Blacklisting and Renewal Fee
- In the event that your website(s) or email account(s) are compromised, leading to the blacklisting of our IP address, you will be subject to an IP Renewal Fee.
- The IP Renewal Fee covers the cost of reassigning a new IP address to your account and mitigating the impact of the blacklisting on our network and other clients.
- The occurrence of an IP Address blacklisting may result from, but is not limited to, website infections, misuse of email accounts for spamming, or other malicious activities originating from your account.
- You acknowledge and agree that it is your responsibility to ensure the security of your website(s) and email accounts to prevent such incidents.
5. Billing and Payment
- All fees for Services are due and payable in advance according to the billing cycle selected by you.
- Failure to pay invoices by the due date may result in suspension or termination of Services.
- You agree to pay any applicable taxes, fees, or charges imposed by governmental authorities in connection with your use of our Services.
- In the event of a security breach, compromise of your account, or any situation requiring additional resources to mitigate and resolve issues (including, but not limited to, the costs associated with blacklisting, time spent investigating, and rectifying the problem), you agree to be charged accordingly. You acknowledge that these fees are non-recoverable due to the costs incurred on our end.
6. Limitation of Liability
We shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our Services.
7. Termination
We reserve the right to suspend or terminate your access to our Services at any time, without prior notice, for violations of these terms and conditions or for any other reason.
8. Amendments
We reserve the right to amend or modify these terms and conditions at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our Services after such changes constitutes acceptance of the amended terms.
